Tend. ("we", "us", "our") provides an AI-powered phone answering service. This policy explains how we collect, use, and protect your personal data when you use our website and services at tendbutler.com.

2. Data We Collect

We collect the following categories of personal data:

  • Account data: Name, email address, and password when you create an account.
  • Phone data: Your phone number and the Tend phone number assigned to you.
  • Call data: Caller phone numbers, call duration, call timestamps, and transcript summaries generated by our AI.
  • Contact data: Names and phone numbers you add to your VIP or blocked contact lists.
  • Calendar data: If you connect Google Calendar, we access your availability (free/busy status) and can create events on your behalf.
  • Payment data: Billing information processed securely through Stripe. We do not store your card details.
  • Usage data: Minutes used, feature usage, and technical logs for service improvement.
  • Device data: Browser type, operating system, and IP address for security and analytics.

3. How We Use Your Data

We process your data for the following purposes:

  • Providing and operating the Tend phone answering service.
  • Generating AI-powered call summaries and delivering them to you.
  • Managing your subscription and processing payments.
  • Checking calendar availability and booking meetings on your behalf.
  • Sending service notifications (call summaries, account updates).
  • Improving our AI models and service quality.
  • Detecting and preventing fraud, spam, and abuse.
  • Complying with legal obligations.

4. Legal Basis for Processing (GDPR)

Under the EU General Data Protection Regulation, we process your data based on:

  • Contract performance (Art. 6(1)(b)): Processing necessary to provide our service to you.
  • Legitimate interest (Art. 6(1)(f)): Service improvement, fraud prevention, and security.
  • Consent (Art. 6(1)(a)): Where you opt in to optional features like call recording or marketing communications.
  • Legal obligation (Art. 6(1)(c)): Tax records, law enforcement requests.

5. Third-Party Services

We use the following third-party services to operate Tend:

  • Supabase (EU region) — Database hosting and authentication.
  • Twilio — Phone number provisioning and SMS delivery.
  • VAPI — Voice AI call processing.
  • Hume AI / ElevenLabs — Voice synthesis for your AI assistant.
  • Stripe — Payment processing (PCI DSS compliant).
  • Google — Calendar integration (with your explicit consent).

Each provider processes data according to their own privacy policies and our data processing agreements.

6. Data Retention

  • Call logs and summaries: Retained for 12 months, then automatically deleted.
  • Account data: Retained while your account is active, deleted within 30 days of account deletion.
  • Payment records: Retained for 5 years as required by tax law.
  • Calendar tokens: Deleted immediately when you disconnect Google Calendar.

7. Data Security

We implement industry-standard security measures including encryption in transit (TLS 1.3), row-level security on all database tables, and secure credential storage. Payment information is handled exclusively by Stripe and never touches our servers.

8. Your Rights

Under GDPR, you have the right to:

  • Access your personal data.
  • Rectify inaccurate data.
  • Erase your data ("right to be forgotten").
  • Restrict or object to certain processing.
  • Data portability — receive your data in a structured format.
  • Withdraw consent at any time.

9. International Transfers

Some of our third-party providers process data outside the EU/EEA. Where this occurs, we ensure appropriate safeguards are in place, including Standard Contractual Clauses (SCCs) approved by the European Commission.

11. Changes to This Policy

We may update this policy from time to time. We will notify you of material changes via email or in-app notification. Continued use of Tend after changes constitutes acceptance.
